If: (a) the Buyer accepts the Seller's Quotation (where the Quotation remains in composing, by executing it); or (b) the Seller accepts the Purchaser's Order, a contract is created in between the parties whereby the Seller offers to the Buyer the Item on these terms. 5. After creation of the contract the order for the Product can just be cancelled by the Buyer if the Seller approvals to the cancellation and the Buyer reimburses the Seller for all expenses associated with the work undertaken in relation to the agreement and likewise pays the Seller an amount equivalent to the profits which the Seller would have attained had the agreement been finished.
6. If the Seller, at any time including after production of the agreement, considers the credit of the Buyer unacceptable the Seller may: (a) need security for payment of the Purchase Rate. (b) Keep shipment up until such security is received, and/or (c) cancel the agreement. 7 (Personal Trainer in Darch ). These conditions (which will only be waived in composing signed by the Seller) shall prevail over all conditions of the Purchaser's order to the extent of any inconsistency.
The delivery time made known to the Buyer is a quote just and the Seller will not be responsible for late delivery or non-delivery consisting of any loss, damage or hold-up occasioned to the Buyer or its customers arising from late or non-delivery. 9. 13. Where the storage is at an area remote from the installation site, transfer of our products to site is the obligation of the purchaser.
14. If the Buyer requires unique packaging in relation to the Goods it need to be concurred to in writing between the Buyer and the Seller, and the cost of the exact same is to the Purchaser's account and accordingly will be included in the Purchase Rate. If the Seller stops working to include the expense of unique packing in the Purchase Cost the Purchaser must pay to the Seller such expenses as needed.

However, if the floor slab is strengthened with grid steel mesh or comparable materials to a level less than 70 mm below the surface area, unique drilling equipment will be required and any extra expenses sustained will be to the purchaser's account.
Unless mentioned in writing our quote assumes an affordable condition of flatness of floor. Flatness tolerances ought to be within + 3 mm inside a 3 metre radius. Additional costs sustained in compensating for a faulty or irregular flooring will be to the buyer's account. 19. 21. The Buyer will pay the Seller right away. If payment is not made on the due date, the Seller may charge interest on the quantity payable at the rate of 5% over the 90 day bank bill rate appropriate on the day the payment is due. 23. The Purchase Rate is not inclusive of goods and services tax, unless otherwise defined in composing.
